Terms of Service

These Terms of Service ("Terms") govern your use of PawfolioBreeder, a software-as-a-service platform operated by PawfolioBreeder ("we," "us," or "our").

By creating an account or using our services, you agree to be bound by these Terms.

1. Account Registration

You must provide accurate, complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2. Acceptable Use

You agree to use PawfolioBreeder only for lawful purposes related to breeding program management and record keeping. You must comply with our Acceptable Use Policy.

3. Content Ownership

You retain ownership of all content you upload to PawfolioBreeder, including photos, documents, health records, DNA reports, pedigree files, and breeding data. We do not claim ownership of your content.

4. Platform Features

PawfolioBreeder provides the following features as part of your subscription:

Breeding animal management with photos, records, and pedigrees
Litter and offspring tracking from birth through placement
Health records including vaccinations, genetic tests, DNA panels, and vet records
Document storage for health certificates, pedigree PDFs, DNA reports, and contracts
AI-powered pedigree import from PDF or image files
DNA genetic profile management with AI loci extraction from uploaded reports
Coat color forecasting using Mendelian inheritance calculations
Trial mating calculator with COI analysis and coat color predictions
Title and show tracking across major registries
Applications and waitlist management with customizable forms
In-app messaging between breeders and buyers
Email campaigns for subscriber communication
In-app contracts with electronic signature via integrated signing
Payment processing via Stripe Connect (see Section 7)
Public breeder website with custom subdomain or custom domain with SSL
Photo albums and gallery for public display
CMS pages for custom content on your breeder website
Audit logs with field-level change history

5. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform maintenance with reasonable notice.

6. Genetic Data

6.1 DNA Report Uploads

When you upload DNA reports to PawfolioBreeder, we process them using AI to extract genetic loci data. The original documents are stored securely in encrypted object storage. Extracted loci data is stored in your account database.

6.2 Use of Genetic Data

Genetic data (loci, genotypes, and coat color forecasts) is used solely for your own breeding program management tools, including coat color forecasting and trial mating analysis. We do not share, sell, or use your genetic data for any purpose other than providing you with the PawfolioBreeder service.

6.3 Accuracy

Coat color forecasts and genetic predictions are provided for informational purposes and are based on known Mendelian inheritance patterns. Actual outcomes may vary due to incomplete data, unknown modifiers, or other genetic factors. PawfolioBreeder does not guarantee the accuracy of genetic predictions.

7. Stripe Connect Payment Processing

7.1 Connected Account

Breeders who enable payment processing through PawfolioBreeder connect their Stripe account via Stripe Connect. By connecting your Stripe account, you agree to Stripe's Connected Account Agreement and Stripe Services Agreement.

7.2 Platform Fee

PawfolioBreeder charges a platform fee of 1.75% on payments processed through Stripe Connect, capped at $75 per transaction. Standard Stripe processing fees also apply and are set by Stripe.

7.3 Refunds and Disputes

Breeders are solely responsible for their refund policies and for resolving payment disputes with buyers. PawfolioBreeder does not mediate refund disputes between breeders and buyers.

7.4 Prohibited Business Types

You may not use PawfolioBreeder's payment processing for any business type prohibited by Stripe's acceptable use policies.

8. Payment and Billing

Subscription fees are billed monthly. You authorize us to charge your payment method on file. Failure to pay may result in account suspension.

9. Dispute Resolution

9.1 Buyer Disputes

Buyers who have concerns about a transaction should contact the breeder directly first. If the issue cannot be resolved, the buyer may contact PawfolioBreeder at support@pawfoliobreeder.com for assistance. We encourage all parties to attempt resolution before initiating chargebacks.

9.2 Platform Disputes

Any disputes between you and PawfolioBreeder regarding these Terms shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with applicable law.

10. Health Records and Public Profiles

Health records, DNA results, and other data you make public on your breeder website are your responsibility. You are solely responsible for the accuracy of information displayed to buyers. PawfolioBreeder is not liable for inaccurate health or genetic information published on your public profile.

11. Account Management

11.1 Subscription Management

You may manage your subscription at any time through your account settings. This includes upgrading, downgrading, or changing your plan. Changes to your subscription take effect at the start of your next billing period.

11.2 Cancellation

You may cancel your subscription at any time through your account settings or by contacting support at support@pawfoliobreeder.com. Upon cancellation:

Your account remains active until the end of your current billing period
You will not be charged for subsequent billing periods
You may continue to access your account in a read-only capacity for 30 days after your subscription ends
You may export your data at any time during this period using the data export feature in your account settings

11.3 Account Deletion

You may request permanent deletion of your account and all associated data by contacting support@pawfoliobreeder.com. Account deletion is irreversible and will permanently remove all breeding records, health data, uploaded documents, and genetic profiles within 30 days of the request. Billing records are retained as required by law (see Section 13).

11.4 Suspension and Termination by Us

We reserve the right to suspend or terminate your account at any time if we reasonably suspect misuse, fraud, violation of these Terms or our Acceptable Use Policy, or any activity that may harm the platform, its users, or third parties. We may also suspend accounts that pose a security risk or are used in a manner inconsistent with the intended purpose of the service. In such cases, we will provide reasonable notice when possible, except where immediate action is necessary to protect the platform, other users, or comply with legal obligations.

12. Support Access

To provide customer support and resolve technical issues, our support team may access your account data, including breeding records, settings, and activity logs. This access is limited to what is reasonably necessary to diagnose and resolve the issue at hand. We do not access your account for any purpose unrelated to providing support, maintaining the platform, or ensuring compliance with these Terms.

13. SMS Terms and Conditions

13.1 Consent

By providing your phone number through a contact form, application, or waitlist on a PawfolioBreeder-hosted breeder website, you consent to receive SMS notifications from PawfolioBreeder on behalf of the breeder you are communicating with.

13.2 Types of Messages

SMS messages are notification-only and may include alerts when a breeder sends you a message, application status updates, and waitlist updates. Each message contains a link to view and reply to the full conversation on our platform.

13.3 Message Frequency

Message frequency varies based on your interactions with breeders on the platform.

13.4 Opting Out and Opting In

You may opt out of SMS notifications at any time by replying STOP to any message. To resume receiving SMS notifications, reply START. You may also manage your notification preferences through your conversation settings.

13.5 Help

For help with SMS notifications, reply HELP to any message or contact support@pawfoliobreeder.com.

13.6 Rates and Carrier Liability

Message and data rates may apply. Check with your wireless carrier for details about your messaging plan. Carriers are not liable for delayed or undelivered messages.

13.7 Privacy

Your phone number and SMS opt-in consent are governed by our Privacy Policy. We do not share your text messaging opt-in data or consent with third parties.

14. Data Retention

General activity logs: Retained for 90 days
Billing and payment records: Retained for 7 years for legal and tax compliance
Breeding data and records: Retained for the duration of your active account plus 30 days after cancellation

15. Limitation of Liability

To the maximum extent permitted by law, PawfolioBreeder shall not be liable for any indirect, incidental, or consequential damages arising from your use of the service, including but not limited to losses arising from genetic predictions, payment processing, or public profile information.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the service after changes constitutes acceptance. We will notify you of material changes via email and in-app notification.
